Pre-Mediation Analysis

Mediation is a negotiation between disputing parties that is managed by an impartial individual, typically an attorney, in order to encourage a productive dialogue of open communications.  Preparation for mediation is an explicit process involving:

• the nature of the relationship
• understanding the contract terms and conditions
• specifying how the parties believe those terms were violated
• clarifying construction documents
• identifying possible resolutions to settle the dispute, etc  

Pre-Litigation Analysis

The analysis for litigation requires best effort evaluation, research, troubleshooting, review of construction documents, site visits, discussions with architects and engineers, reviews of agreements, etc.  The process often carries the additional burden of a protracted time frame depending on the complexity of the complaint and the court’s schedule. Also with pre-litigation analysis a high duty to preserve information is triggered when a party should have known that information discovered in the analysis may become evidence in pending or anticipated litigation.
